01 Introduction
By engaging FlowCraft Web — paying a deposit, signing a quote, or otherwise authorizing work to begin — you accept these terms. If you don't agree to any part of this document, please don't engage us.
We work as an independent studio. We are not your employee. We do not have authority to bind your business beyond the work agreed in writing.
02 Services we provide
FlowCraft Web provides four core services, individually or bundled into a package:
- Website design and build
- AI automation and lead-capture system setup
- Monthly support, hosting, and maintenance
- Custom Build engagements with a discovery phase
The exact scope of any engagement is defined in the written quote, proposal, or order summary we send before work begins. The quote takes precedence over any general statements on our website or marketing materials.
03 Website design services
Website design includes layout, page-level design, copy edits to client-provided content, responsive build for desktop, tablet, and mobile, basic on-page SEO structure (titles, descriptions, headings, schema markup), and integration with the platform of our choice (typically a static or low-code stack).
Unless otherwise stated, websites are delivered with up to the page count and feature set listed in the package or quote. Additional pages and features are quoted as add-ons.
04 AI automation setup
AI automation engagements may include lead-form routing, follow-up email sequences, AI-assisted reply drafts, calendar booking, and integration with workflow tools like n8n, Make, Zapier, Google Sheets, CRMs, and email providers.
We configure these systems on your behalf, using third-party platforms. The third-party platforms charge their own subscription fees, which are separate from our service fees and remain your responsibility once handed off.
05 Monthly support & maintenance
Starter, Growth, and Automation Pro plans include monthly support: hosting, security patches, plugin and platform updates, small content edits, performance monitoring, and reasonable assistance with day-to-day site needs.
Monthly support does not include net-new features, redesigns, additional pages, integrations not previously configured, or new automation workflows. Those are quoted separately as add-ons or scope expansions.
06 Client responsibilities
To deliver your project on time and on budget, we need timely cooperation from you. Specifically:
- Provide content (copy, photos, logos) within the timeframes we agree to
- Review and respond to design or build deliverables within 5 business days
- Provide accurate information about your business, services, and customers
- Pay invoices on the agreed schedule
- Inform us promptly of any changes to your contact details, hosting accounts, or business information that affect the work
If client-side hold-ups extend past 30 days, we may pause the engagement and resume only when you're ready, with the timeline adjusted accordingly.
07 Project timeline & delays
Timelines are estimates given in good faith. We commit to working efficiently and communicating delays as they arise. Most projects launch within their estimated window.
Delays caused by client-side hold-ups (unprovided content, pending feedback, scope changes) extend the timeline accordingly. Delays caused by FlowCraft Web (illness, capacity issues, force majeure) are communicated promptly and the timeline adjusted in good faith.
08 Payment terms
Setup fees are payable as follows unless otherwise agreed in writing:
- 50% deposit on engagement (before work begins)
- 50% balance on launch / handover
Monthly retainer fees are billed monthly in advance, beginning on the launch date. Custom Build engagements may follow a milestone-based payment schedule defined in the quote.
Invoices are due on receipt. Accounts past 14 days may be paused. Accounts past 30 days may have hosting and services suspended until brought current.
09 Setup fees & monthly retainers
Setup fees are one-time charges for the initial build or system configuration. They are paid in two halves (50% / 50%) as described in section 08.
Monthly retainers are recurring monthly subscriptions to ongoing services (hosting, support, maintenance, automation upkeep). Retainers are charged automatically on the same calendar day each month, beginning on the date your service goes live.
10 One-time website builds
One-time builds (the One-Time Website package) are paid in full as a single fee covering design, build, launch, and a brief handover. There is no ongoing monthly retainer with this package.
One-time builds do not include monthly maintenance, hosting, support, or automation upkeep. You are responsible for hosting, ongoing security, and updates after handover unless you choose to add a maintenance plan separately.
11 Revisions & scope changes
Each package includes a defined number of revisions per design phase, listed in the quote. Additional revisions beyond that allotment are billed at our published hourly rate or quoted as a fixed add-on.
Scope changes — items outside the original quoted scope (additional pages, new features, new integrations) — are quoted separately. We do not silently absorb scope creep, and we don't charge surprise fees either; everything is agreed in writing first.
12 Ownership of website files & content
Once a project is paid in full, you own the final deliverables — the website, the content, and the code we produced for your business. You can host it where you want, modify it, or take it elsewhere.
Until full payment is received, intellectual property rights remain with FlowCraft Web. We retain the right to display non-confidential portions of our work in our portfolio and marketing materials unless you request otherwise in writing.
You retain ownership of all content you provide to us (logos, photos, copy, brand assets).
13 Hosting, domains & third-party tools
For Starter, Growth, and Automation Pro plans, hosting is included in the monthly fee on a platform of our choice. If you cancel monthly support, you can move the site to your own hosting at any time and we will assist with the handoff.
Domains are typically registered in your name through a registrar of your choice — you own them outright. If we register a domain on your behalf, we will transfer it to your account at any time on request.
Third-party tools and platforms (email providers, CRMs, automation tools, payment processors) charge their own subscription fees and are governed by their own terms. We are not responsible for outages, pricing changes, or feature changes made by those providers.
14 AI automation limitations
AI-generated outputs (auto-replies, draft messages, summaries) can be incorrect, incomplete, or unexpectedly worded. We configure systems to use AI as a draft-and-review assistant rather than as a final unsupervised actor.
You are responsible for reviewing automated outputs that go to your customers, keeping API keys and credentials secure, and informing us promptly if an automation is misbehaving so we can correct it. We are not liable for damages caused by AI outputs to your customers when those outputs were generated by third-party models we do not own.
15 Client-provided content
You confirm that any content you provide to us — logos, photos, copy, testimonials, customer names, brand assets — you have the legal right to use and to publish on a public website.
If a third party claims you do not have those rights, you agree to indemnify FlowCraft Web for losses or expenses arising from publishing your provided content. We reserve the right to remove material that appears to infringe third-party rights, with notice to you.
16 No guarantee of specific business results
We commit to performing services with reasonable skill and care, consistent with industry standards. Beyond that, our services are provided "as is."
We do not guarantee specific business outcomes — lead volume, traffic, conversions, revenue, or sales. Those depend on factors outside our control: your market, your offers, ad spend, seasonality, the quality and frequency of your follow-up, and external economic conditions. We will help you measure and improve, but we cannot promise results in advance.
17 Cancellations
You may cancel a monthly support engagement at any time by emailing us. The current month's fee remains due and your service continues through the end of the billed period. We will not invoice you again after cancellation takes effect.
One-time builds and milestone-based engagements may be cancelled mid-project. Refund eligibility is governed by the refund policy in section 18.
18 Refund policy
15-day refund window. If you decide within 15 calendar days of paying your initial deposit or fee that you'd like to cancel — and we have not yet delivered a substantial portion of the work — we will refund your payment minus any reasonable costs already incurred (typically third-party fees, stock assets, hosting setup, or work hours already logged).
After 15 days, deposits, setup fees, and work-in-progress fees are non-refundable. This is because we begin allocating studio capacity, conducting research, and producing strategy and design work as soon as the engagement starts. Once that work is underway, the time cannot be recovered.
Monthly support payments are generally non-refundable once the billing period has started. You can cancel at any time; the current month remains due, future months stop. We do not pro-rate partial months.
Third-party costs — paid hosting, paid software licenses, stock photo licenses, premium plugins, paid API services — are non-refundable, as we do not control those vendors' refund policies.
Case-by-case partial refunds. If a project is cancelled before substantial work begins, FlowCraft Web may at its discretion offer a partial refund based on the work already completed. Email us with your situation; we treat these requests fairly.
19 Support limitations
Monthly support covers the work described in section 05 above. It does not cover:
- Net-new features, redesigns, or additional pages
- New integrations not part of the original build
- Recovery from issues caused by changes you or another vendor made directly to the site
- Custom development work outside the scope of the package
- Emergency 24/7 response — we work standard business hours, with reasonable effort to handle urgent issues quickly
Extra-scope work is quoted separately. We will tell you before doing it; we won't surprise you with an invoice.
20 Acceptable use
You agree not to use our services to host or distribute content that is illegal in the jurisdictions where it is published, that infringes the intellectual property of others, that promotes hate or violence, that misleads consumers in ways that violate consumer protection law, or that violates the terms of the third-party platforms we use to host your site.
We reserve the right to refuse or terminate service for content that violates these standards.
21 Limitation of liability
Our total liability to you for any claim arising from these terms or our services is limited to the amount you have paid us in the 6 months preceding the claim. We are not liable for indirect, consequential, incidental, or punitive damages, including but not limited to lost profits, lost revenue, or loss of business opportunity.
These terms are governed by the laws of the Commonwealth of Massachusetts, United States. Any dispute that cannot be resolved through good-faith communication will be resolved through binding arbitration in Massachusetts, or in a Massachusetts state or federal court if arbitration is not available.
22 Changes to these terms
We may update these terms from time to time. The "Last updated" date at the top of the page reflects the most recent revision. Material changes will be communicated to active clients in writing, and continued use of our services after a change constitutes acceptance of the updated terms.
